If you do not agree, please do not use the service.

2. Nature of the service

HeartMadeMusic creates custom, personalized songs based on the details you choose to share.

Each song is:

• created individually for one child or family
• written and produced specifically for the order
• intended as a meaningful, personal gift

Songs are not pre-made, templated, or reused.

3. Responsibility for submitted content

By submitting information, you confirm that:

• you are a parent or legal guardian, or have permission to submit the information
• the details you provide are accurate to the best of your knowledge
• you have the right to share this information

HeartMadeMusic is not responsible for inaccuracies or omissions in the information you submit.

4. Content use and privacy

Names, stories, and personal details are used only to create your song.

We do not:

• publish songs publicly without permission
• use personal details for advertising
• sell or share song content with third parties

Songs may be temporarily stored for operational purposes and then deleted.

5. Payments

All payments are:

• one-time payments
• processed securely through third-party providers such as Stripe

We do not store payment card details.

6. Revisions and refunds

Because each song is custom-made:

• Revisions are included, if requested, to help ensure the song feels right
• If you are not satisfied after reasonable revisions, you may request a refund

Refund decisions are handled fairly and in good faith.
Abuse of the revision or refund process may result in refusal of service.

7. Delivery times

Songs are typically delivered within 48 hours of receiving the required details.

Delivery times may vary due to:

• complexity of the request
• revision requests
• technical or operational delays

We are not responsible for delays caused by incorrect email addresses or emails landing in spam or promotions folders.

8. Intellectual property

• song compositions
• lyrics
• recordings
• branding and presentation

You are granted a personal, non-commercial license to:

• listen to the song
• share it privately
• gift it to the intended recipient

You may not:

• resell the song
• claim authorship

Any songs shared publicly as examples are done so only with explicit permission from the customer.
